Finca La Libertad General conditions as of March 2020


Terminology

The terms "La Libertad", "Coín" are terms for Finca La Libertad in Coin. Guest: a person who has made a reservation and is staying at Finca La Libertad in Coín and who is registered as such. Main guest: the person who made a reservation at Finca la Libertad. The lead guest must be over 18 years of age and is responsible for his/her fellow guests. Manager: the person who manages the rental property as owner or on behalf of the owner. Third Parties: any other legal entity that is not a guest, administrator or owner. Reservation: a confirmation of the reservation request by La Libertad, Coín. Cancellation: Revocation or cancellation of the definitive reservation within the applicable term or a no-show at the time of the reservation.


1. General

1.1 Our company is described in the website www.fincallibertad.com . This website has been compiled with the greatest care, but there may be differences between the text and/or photos presented on the website and the current situation in the casitas at the time of the guest's visit. No rights can be derived by the guests from such differences.

1.2 The minimum stay in La Libertad, Coin is 2 nights. During the holiday periods and/or in the summer months, a different minimum stay may apply.

1.3 Our casitas are accessible 24 hours a day. The casitas have their own lockable entrance.

1.4 Rest times are from 10 pm to 7 am. We kindly ask you to limit noise within these times.

1.5 Smoking is not allowed in the rooms or in the common areas or anywhere indoors. Smoking is allowed outside.

1.6 Pets of guests are only allowed in the winter period at finca la Libertad, Coín,

1.7 The Casitas are suitable for a maximum of 4 people (casita 57m2) or a maximum of 5 people (casita 67m2)

1.8 Check-in is possible between 3:00 PM and 10:00 PM, check-out is no later than 11:00 AM. Later check in and check out is possible in consultation.

1.9 Guests can park their car in our own car park. Parking is at your own risk.

1.10 Guests must have a permanent place of residence or residence.

1.11 Guests must follow the instructions of the owners.

1.12 The owners can deny and/or refuse access to La Libertad, Coin with immediate effect, in the event of violation of the general terms and conditions and/or the internal rules or inappropriate behavior, without further notice and reasons and without refund of accommodation costs. .

1.13 Guests of La Libertad, Coín must adhere to the internal rules provided to them online when booking.


2: Rates

2.1 The rates include gas, water, electricity, internet and heating. The rates include VAT and tourist tax.

2.2 The rates do not include the costs of cancellation and/or travel insurance and/or other costs.

2.3. Rates are always without obligation and are subject to interim changes.

2.4 All entries on the website of finca La Libertad, Coín (www.fincalalibertad.com) are deemed to have been provided in good faith and are always subject to interim adjustments. La Libertad, Coin is not bound by apparent errors on its website.

2.5. We use adjusted rates for winter visitors. Do you have questions about that? Feel free to send an e-mail or whats app message or give us a call.


3.0 Reservation and Payment

3.1 The reservation is only final after confirmation of your reservation request by La Libertad, Coin.

3.2 For reservations, 50% of the reservation amount must be paid to La Libertad, Coin within 8 days after reservation. A reservation confirmation will only be issued after receipt of this advance payment. The remaining amount of the stay must be paid on arrival. The advance and/or the total accommodation costs must be transferred to: La Libertad, Coin: den Bekker IBAN: ES09 0237 0644 8091 7258 4004. Credit cards are not accepted and payment by PIN is not possible. If the check in date is within 8 days of booking, payment is made by bank transfer of the full amount at the time of booking.


4.0 Cancellation

4.1 You are personally liable for cancellations due to calamities and/or force majeure shortly before or during your stay. Our advice is to take out cancellation and/or travel insurance for this. View our cancellation conditions below.

4.2 In case of cancellation up to 60 days before arrival, we charge 25% of the accommodation costs. If canceled between 30 and 60 days before arrival, 50% of the accommodation costs. In case of cancellation between 14 and 30 days before arrival 75% of the accommodation costs. In case of cancellation from 14 days before departure, the full accommodation costs.

5.0 Damage

5.1 The guest must behave properly and use La Libertad, Coin in accordance with the reasonable instructions for use given by La Libertad, Coin or the owner/manager.

5.2 The main guest is legally liable for damage caused by him or his fellow guests to La Libertad, Coín accommodation or the items present therein.

5.3 A claim (damage, loss, missing and/or theft) must be reported immediately by the guest to the owner or manager. Repair and or replacement costs must be immediately reimbursed by the guest to the owner / manager at his first request.

5.4 In the event of loss or otherwise non-return of keys to the casita, all resulting costs will be charged to the main guest. The main guest undertakes to pay this within 14 days after sending the substantiated invoice.

5..5 If the keys are not handed in at check-out, the main guest is obliged to send the keys to La Libertad, Coín by registered mail within 2 working days or to return them physically.


6.0 Complaints

6.1 The guest is always entitled to submit his grievances to the owners by means of a complaint. The owners of finca la Libertad must always handle a complaint adequately and expeditiously, so that the complaint is treated according to standards of reasonableness and fairness.


7.0 Force majeure

7.1 In the event of force majeure, both permanent and temporary, de La Libertad, Coín is entitled to dissolve or temporarily suspend the agreement in whole or in part, without the guest being able to claim fulfillment and/or compensation. Force majeure includes, but is not limited to: danger of war, war, insurrection, molestation, strikes, boycotts, disruptions in the energy or water circuit, in traffic or transport, government measures, scarcity of raw materials, natural disasters and, furthermore, all circumstances , extraordinary weather conditions, death of one of the owners or close relatives, etc., under which full or partial fulfillment of the agreement cannot reasonably and fairly be expected from La Libertad, Coín.


8.0 Liability

8.1 La Libertad, Coin cannot be held liable for damage suffered by the guest or third parties as a result of the stay in or near the accommodation; the guest indemnifies the La Libertad, Coin against claims in this regard. La Libertad, Coin is not liable for disruptions in and around the accommodation, such as disruptions and failure of power and water supplies and technical installations, construction and/or road works not announced or untimely announced in the vicinity of La Libertad, Coin.

8.2 Finca la Libertad can only be held liable for damage that is due to the gross negligence or negligence of the owners.

8.3 Without prejudice to the provisions of 8.1 and 8.2, the liability of Finca la Libertad, if and insofar as Finca la Libertad is held legally liable for any reason with regard to the user agreement, is always limited to direct damage and any form of consequential damage is excluded. The liability of Finca la Libertad is furthermore always limited to the maximum amount that the insurer of Finca la Libertad will pay out in the appropriate case.

8.4 Finca la Libertad accepts no liability for injury to persons and/or damage, loss or theft of property of the users.


9.0 Privacy

10 Final provision

10.1 Unless otherwise provided in private international law rules, these terms and conditions are exclusively governed by Spanish law. Non‐Spanish guests are deemed to agree to the terms and conditions drawn up in Dutch.

10.2 All disputes arising from the user agreement or these terms and conditions will be settled in the first instance by the competent court in Spain, insofar as the rules of private international law do not provide otherwise.

10.3 None of the parties can transfer its rights and obligations to third parties, unless otherwise stated in these terms and conditions.

10.4 If and insofar as any provision in the user agreement and the present terms and conditions should prove to be invalid, the other terms and conditions will remain in force and the
